Welcome to ServerVerify.com (“ServerVerify,” “we,” “our,” or “us”). These Terms of Service & Conditions (“Terms”) govern your access to and use of the ServerVerify website, services, and related features (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, discontinue use immediately.

1. Eligibility

You must be at least 18 years old to use the Platform. By using ServerVerify, you represent and warrant that you meet this requirement and that all information you provide is truthful and accurate.

2. Account Registration and Security

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials secure.
• Accept responsibility for all activity under your account.

ServerVerify reserves the right to suspend or terminate accounts at its discretion.

3. User Contributions

Users may submit benchmarks, reviews, comments, and other materials (“User Contributions”). By submitting, you grant ServerVerify a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, display, distribute, and adapt such content for operation of the Platform.

You represent and warrant that:

• You own or control the rights to your contributions.
• Your contributions do not violate third-party rights, laws, or these Terms.
• You will not post false, misleading, defamatory, fraudulent, or abusive content.

ServerVerify may remove, edit, anonymize, or refuse to display contributions at its discretion.

4. Benchmarks and Reviews

As part of our data aggregation process and at user request:

• Private Submissions: Benchmarks and reviews may be made private. Private submissions remain stored in the system but are excluded from public leaderboards, global rankings, and external displays.
• Anonymized or Refined Submissions: Certain benchmarks and reviews may be anonymized or refined. This may occur when:
• A user requests anonymization of their contribution.
• ServerVerify aggregates reviews or benchmarks from its own platform and/or third-party/global sources.
• We determine, at our discretion, that anonymization or refinement is necessary to protect privacy, remove personal data, enforce compliance, or improve readability and consistency.
• In such cases:
• Numerical ratings, scores, and core evaluative content are never altered.
• Usernames and identifying information may be replaced with pseudonyms or generic identifiers.
• Portions of review text may be refined, rewritten, summarized, or adjusted for clarity, grammar, tone, readability, or removal of sensitive/private data.
• Automated tools, including artificial intelligence systems (such as ChatGPT), may be used to assist in anonymization, refinement, or aggregation.
• The intent, sentiment, and substantive meaning of the review will never be changed, but presentation and identifiers may be adapted to align with ServerVerify’s editorial and compliance standards.

You acknowledge and agree that ServerVerify has broad discretion to anonymize, refine, edit, or otherwise modify benchmarks and reviews for purposes of privacy, quality control, consistency, and compliance.

5. Reporting Content

Any user, including hosting providers, may flag reviews or benchmarks they believe violate these Terms by using the “Report” button provided on each review or benchmark. Reported content will be reviewed by ServerVerify, which reserves the right, in its sole discretion, to take appropriate action, including removal, anonymization, or rejection of the flagged material.

6. Provider Listings and Data Accuracy

Provider profiles, performance data, and rankings are compiled from user submissions, benchmarks, public data, and third-party sources. While we strive for accuracy, ServerVerify makes no guarantees that:

• Data is complete, accurate, unbiased, or up to date.
• Benchmarks reflect actual performance under all conditions.
• Reviews represent the overall quality, reliability, or reputation of a provider.
• Aggregated or AI-refined content is free from errors, omissions, or misinterpretations.

You agree not to rely solely on the Platform for decision-making and to conduct your own independent due diligence.

7. Automated Tools and AI Disclaimer

ServerVerify may use automated tools, including artificial intelligence, to generate, refine, summarize, or edit data, reviews, and benchmarks. Such content is provided strictly on a best-effort basis, and we disclaim any responsibility for errors, omissions, or inaccuracies resulting from these processes.

8. Ranking Methodology Disclaimer

Rankings and scores on the Platform are generated through ServerVerify’s internal algorithms, which may change over time without notice. Rankings should not be interpreted as endorsements, certifications, or guarantees of performance. ServerVerify reserves the right to modify ranking methodologies at its discretion.

9. No Warranty; Best Effort Only

The Platform, including all benchmarks, reviews, rankings, provider data, and aggregated content, is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

We expressly disclaim all warranties, including but not limited to:

• Accuracy, reliability, or completeness of data.
• Merchantability, fitness for a particular purpose, or non-infringement.
• Continuous, error-free, or secure operation of the Platform.

All content and services are provided strictly on a best-effort basis.

10. Availability and Service Interruptions

ServerVerify does not guarantee uninterrupted access to the Platform. The Platform may be unavailable due to maintenance, updates, outages, or other interruptions. We are not liable for any damages caused by such unavailability.

11. Limitation of Liability

To the maximum extent permitted by law, ServerVerify and its owners, affiliates, directors, employees, and agents shall not be liable for any damages, including but not limited to:

• Direct, indirect, incidental, or consequential damages.
• Loss of profits, revenue, or business opportunities.
• Damages resulting from reliance on benchmarks, reviews, or provider data.

Your sole remedy for dissatisfaction with the Platform is to discontinue use.

12. Indemnification

You agree to indemnify, defend, and hold harmless ServerVerify, its owners, and affiliates from any claims, damages, liabilities, losses, costs, or expenses (including legal fees) arising out of:

• Your use of the Platform.
• Your User Contributions.
• Your violation of these Terms or applicable law.

13. Intellectual Property

All rights, title, and interest in the Platform, including its design, features, and software, are owned by ServerVerify or its licensors. Users retain rights to their contributions but grant ServerVerify a license as described in Section 3.

14. Copyright Complaints

If you believe content on ServerVerify infringes your copyright, please notify us in writing with sufficient detail to identify the material. We will respond in accordance with applicable U.S. law, including the Digital Millennium Copyright Act (DMCA).

15. Modifications and Termination

We may update or modify these Terms at any time, with notice by updating the “Last Updated” date. Continued use of the Platform constitutes acceptance of updated Terms. We may also suspend or terminate access to the Platform at any time without liability.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Erie County, New York.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms represent the entire agreement between you and ServerVerify regarding your use of the Platform and supersede any prior agreements.
